Flexible Rate Options

Because one size does not fit all.

Some cases don’t require a full day of mediation to get settled.  Some arbitrations can be decided without hearings or with hearings limited in time or scope.  Some disputes are even settled through neutral-assisted negotiation before mediation, arbitration, or a hybrid process become necessary. 

Our flat rate options provide cost efficiencies for applicable cases.  At the same time, we offer the flexibility to continue at our regular hourly rate if needed.  In addition, we provide a convenient method of making payments within the same secure client portal used to transmit documents.  Everything you might need to do can be done in one convenient and secure place.

Standard rate:

Our standard rate is $280/hour for prep and mediation/arbitration time.  We do not charge for travel.

For parties represented by counsel, our contract for services is directly with the attorneys and payment for services rendered is expected directly from counsel.  For unrepresented parties, we require a four-hour minimum payment to be made when the dispute resolution date is scheduled.

If a mediation or arbitration is canceled or rescheduled prior to one week before the scheduled date, no cancellation/reschedule fee is charged.  If a scheduled date is canceled or rescheduled one week or less from the scheduled date, a cancellation/reschedule fee of $350 per party may be charged.

Flat-rate options (for less complex disputes):

Documents-only arbitration:

  • Submit summary of case, arguments, and evidence 1 week prior to arbitration date.  (Letter brief up to 7 pages, exclusive of exhibits.)
  • Decision within 72 hours of arbitration date (excluding weekends) (unless arbitrator requests additional information from either party, in which case, decision within 72 hours (excluding weekends) of receiving information requested).

$475 per party paid when arbitration date is scheduled. 

Limited ODR (online) arbitration:

  • Submit summary of case, arguments, and evidence 1 week prior to arbitration date.  (Letter brief up to 7 pages, exclusive of exhibits.)
  • Up to 2 hour video or telephone hearing.  (Each party receives 40 minutes to present evidence and arguments and 10 minutes to rebut and conclude.)
  • Decision within one week of arbitration date (unless arbitrator requests additional information from either party, in which case, decision within one week of receiving information requested).

$685 per party paid when arbitration date is scheduled.

Limited ODR (online) mediation:

  • Submit summary of case, arguments, and evidence 1 week prior to mediation date.  (Letter brief up to 7 pages, exclusive of exhibits.)
  • Up to 4 hours online mediation time.
  • Additional time billed at $280/hour.

$685 per party paid when mediation date is scheduled.

Limited med-arb:

  • Submit summary of case, arguments, and evidence 1 week prior to dispute resolution date.  (Letter brief up to 7 pages, exclusive of exhibits.)
  • Up to 4 hours mediation time to reach agreement.
  • Each party then receives 20 minutes to present evidence and arguments, 5 minutes to rebut and conclude.
  • Decision within one week of med-arb date (unless neutral requests additional information from either party, in which case, decision within one week of receiving information requested).
  • If parties are close to a resolution after four hours of mediation and agree to continue mediating instead of proceeding to arbitration, one additional hour of mediation time will be included instead of proceeding to arbitration and any additional time thereafter will be billed at $280/hour.

$995 per party paid when med-arb date is scheduled.

Limited arb-med:

  • Submit summary of case, arguments, and evidence 1 week prior to dispute resolution date.  (Letter brief up to 7 pages, exclusive of exhibits.)
  • Up to 2 hour hearing.  (Each party receives 40 minutes to present evidence and arguments and 10 minutes to rebut and conclude.)
  • 3 hours mediation time to reach agreement.
  • Decision within one week of arb-med date (unless neutral requests additional information from either party, in which case, decision within one week of receiving information requested).
  • If parties are close to a resolution after three hours of mediation and agree to continue mediating, additional time will be billed at $280/hour.

$995 per party paid when arb-med date is scheduled.

Neutral-Assisted Negotiation:

$195 per party ($390/case).  (If unrepresented parties reach settlement through neutral-assisted negotiation and would like assistance in drafting a final settlement agreement, Pax may draft a binding settlement agreement and obtain the parties’ signatures for a reduced rate of $180/hour.)
